Gene patenting is the exclusive rights to a specific DNA sequence (gene) given by the government to an individual or organization who claims to identify the gene first. According to the Indian Patent Act, 1970, patenting of life forms is prohibited. However, the techniques of genetic manipulation can be patented. So, unlike the rest of the world, Indian Patent laws only allow process patent and not product patent.
